Terms of Service

1. About Us

"Bellator Funnel Command" (the "Service") is a trading name of Mitchell Tucker, a sole proprietorship based in the United States ("Mitchell Tucker", "we", "us", "our", or the "Seller"). By using the Service, you are contracting with Mitchell Tucker.

2. Acceptance of Terms

By accessing, registering for, or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. The Service

The Service provides lead tracking, campaign management, link and video tracking, lead scoring, analytics, and Telegram alerts for marketing funnels.

4. Acceptable Use

You are solely responsible for your account, your credentials, and all activity that occurs under your account. You must keep your login credentials confidential and notify us promptly of any unauthorized use. You agree to provide accurate information and to keep it current.

You agree not to misuse the Service. You must not:

  • Use the Service for any unlawful purpose or in violation of any applicable law, regulation, or third-party rights
  • Send unsolicited communications, spam, bulk messaging, or any outreach that violates anti-spam laws including the U.S. CAN-SPAM Act, Canada's CASL, the EU GDPR and ePrivacy Directive, the UK PECR, the TCPA, or any similar law in the recipient's jurisdiction
  • Contact, store, or process information about any lead, prospect, or individual without a lawful basis and, where required, their prior consent
  • Engage in fraud, phishing, impersonation, deceptive marketing, pyramid schemes, get-rich-quick schemes, or any misleading or manipulative practices
  • Promote, sell, or facilitate adult or sexually explicit content, gambling, weapons, illegal drugs or paraphernalia, hate speech, harassment, violence, self-harm, exploitation of minors, or any content prohibited by Paddle's Acceptable Use Policy or restricted business categories
  • Use the Service for regulated activities (including but not limited to financial, legal, medical, or investment advice) without holding the required licenses and qualifications in every applicable jurisdiction
  • Infringe the intellectual property, privacy, publicity, or contractual rights of any other person or entity
  • Upload, transmit, or distribute viruses, malware, ransomware, or any other harmful code
  • Attempt to interfere with, disrupt, degrade, or circumvent the security or integrity of the Service, including probing, scanning, penetration testing without consent, scraping, rate-limit evasion, or unauthorized access
  • Reverse engineer, decompile, disassemble, resell, sublicense, or redistribute any part of the Service
  • Use the Service to build a competing product, or to train machine-learning models without our prior written consent
  • Share, transfer, or allow third parties to use your account, or exceed any usage limits associated with your subscription plan

You are responsible for all content, leads, and data you upload, send, or process through the Service, and for ensuring that your use complies with all laws applicable to you and the people you contact. We may, at our sole discretion and without prior notice, investigate suspected violations, remove or restrict offending content, refuse service, and suspend or terminate accounts that violate this section. Repeated or serious violations may be reported to Paddle and to law enforcement where appropriate.

5. Intellectual Property

We retain all rights, title, and interest in the Service, including all software, documentation, branding, and related intellectual property. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan.

6. Payments, Subscriptions, and Refunds — Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refunds are governed by Paddle's Checkout Buyer Terms and Refund Policy, in addition to our own Refund Policy.

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You can manage or cancel your subscription at any time from your billing page or via paddle.net.

7. Service Level and Warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

9. Suspension and Termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time by canceling your subscription.

10. Governing Law

These Terms are governed by the laws of the seller's jurisdiction (United States), without regard to conflict-of-laws principles.

11. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
